PSM's response to Nazri Aziz' accusations against EO6

PSM would like to respond to the unscrupulous comments made by Law Minister -   Mohamed Nazri Abdul Aziz in defending the use of the EO on the PSM 6.

In his statement, Nazri said

i) Police have acted within their jurisdiction to detain the six Parti Sosialis Malaysia (PSM) members regarding security issues,

ii) The police had the right to use either the Emergency Ordinance (EO) or the Penal Code since the six were suspected to revive the communism ideology which had been banned in Malaysia.

iii) He said the EO was enacted and came into power as a measure to curb communist resurgency in 1948 to 1960, and also for a brief state of emergency following the May 13, 1969 racial riot, “it was retained to ensure that such incidents do not recur”.

PSM would like to point out the following :

i)          EO is not to  used to curb communism but ISA is.         The current emergency law under EO to detain for 60 days is the emergency law in 1969 Emergency (Public Order And Prevention Of Crime) Ordinance, 1969 enacted in 16th May, 1969 whereas, it is different from the ISA where The stated purpose of the ISA was to deter communist activity in Malaysia during the Malayan Emergency and afterwards.

ii)         The charges against Jeyakumar and 5 others are not about communism but it is about BERSIH  2.  The charge on the remaining 24 is not waging a war with the king but distributing Bersih leaflets and being involved with an illegal organization – BERSIH 2.

iii)         None of 37 affidavit of the Government talk about commu8nism but talsk about BERSIH 2

iii)         July 4, 2011 - Datuk Seri Hishammuddin Hussein said books and other material that promoted “subversive ideologies” would be given due consideration by the authorities if they did not incite people to join Bersih’s July 9 rally.

Hubungan UMNO dengan Parti Komunis

i)          Mohd Ali berkata Parti Komunis Cuba mengenali rapat Umno dan BN kerana parti itu menghantar wakilnya setiap tahun sejak beberapa tahun lalu bagi menghadiri Perhimpunan Agung Umno di Kuala Lumpur."Mereka mengucapkan tahniah atas kelancaran perjalanan Umno. Pada tahun ini mereka akan menghantar wakil ke Perhimpunan Agung Umno dan berharap akan terus dapat menghantar wakil pada tahun-tahun akan datang," katanya. (20-6-2007)

ii)            Tengku Adnan yang juga Setiausaha Agung BN baru sahaja kembali ke tanah air selepas menandatangani memorandum persefahaman (MoU) pertukaran dan kerjasama antara UMNO dan CPC di Beijing, 5 Ogos 2010. Sepanjang pemberontakan komunis di negara ini pada 1948-60, dan kemudiannya serangan gerila diteruskan sehingga perjanjian damai 1989, CPC memberi sokongan penuh kepada Parti Komunis Malaya (PKM).

iii)          Delegasi seramai tujuh orang yang diketuai oleh Setiausaha Agungnya, Dr. Nguyen Minh Tuan Dari Parti Komunis Vietnam, disambut mesra oleh kakitangan bertugas di Ibu Pejabat UMNO sebelum diberikan ucaptama oleh Setiausaha Kerja UMNO, Datuk Abdul Rauf Yusoh 29-1-2010
