The Special Constituency Allocation

For 3 decades the BN leadership had been allocating between RM 300,000 and RM 2 million per year as Constituency Allocations.
This sum is disbursed by the Implementation Coordination Unit in the Prime Minister’s Department, and is made available to Members of Parliament from the Barisan Nasional but never to any MP from the Opposition. After applying several times to the ICU and following up with questions in Parliament (and keeping a record of all of this), Dr Jeyakumar Devaraj, the MP for Sg Siput, filed a Judicial Review on this unfair practice on the part of the BN Government. Dato Ambiga Sreenevasan agreed to serve as Counsel, and the case was filed at the Jln Duta Court on 29th October 2010.
We managed to obtain Leave from the High Court. But the Federal Counsel appealed this and the Appeal Court withdrew the Leave. The matter was then referred to the Federal Court which upheld the Appeal Court decision. The Appeal Court and the Federal Court held that it would be beyond their powers to evaluate or censure decisions of the Executive.
