SEMENYIH, SELANGOR – 17 FEBRUARI 2019: Selain mengisytiharkan harta pada hari ini, Nik Aziz Afiq, calon Parti Sosialis Malaysia (PSM) untuk Pilihanraya Kecil (PRK) kawasan DUN Semenyih, turut melafazkan Ikrar Anti-Rasisme di hadapan wartawan-wartawan dan pengundi-pengundi Semenyih.

Nik Aziz mengatakan bahawa diskriminasi perkauman dan politik perkauman bagai satu penyakit kronik yang menghancurkan rakyat Malaysia pada masa kini.

Dalam Ikrar Anti-Rasisme yang dilafazkan oleh Nik Aziz, beliau berjanji sebagai seorang pendukung perjuangan menentang perkauman bahawa:

  1. Tidak akan mempermainkan apa jua isu politik perkauman untuk meraih undi atau sokongan daripada rakyat.
  2. Menjauhi daripada menggunakan apa jua unsur perkauman dalam semua aktiviti kempen pilihanraya, termasuk ceramah, komen, kenyataan akhbar, tulisan media sosial, risalah, sepanduk atau apa-apa bahan kempen yang akan mendiskriminasi atau mewujudkan kebencian terhadap suatu kaum yang lain atau warga migran.
  3. Memastikan bahawa semua aktiviti dan perjuangan PSM adalah berdasarkan kepada kelas masyarakat dan bukannya berdasarkan warna kulit atau kaum. Kumpulan sasar dan perjuangan PSM adalah berdasarkan kaum tertindas tanpa mengira warna kulit.

: The Parti Sosialis Malaysia (PSM) candidate for the Semenyih state assembly by-election has declared his assets and hoped his three opponents will do the same.

Nik Aziz Afiq Abdul said he was single and stayed with his parents and declared that his nett asset worth was RM15,750.

Nik Aziz Afiq, who runs a masseuse business, disclosed that his assets comprised savings of RM1,000 in a local bank and a Perodua Axia car purchased in 2017.

The 25-year-old also declared that he has a RM19,250 outstanding debt with the National Higher Education Fund (PTPTN).

Meanwhile, Nik Aziz Afiq said he was willing to declare his assets every year if he won the Semenyih by-election on March 2.

“It is part of PSM’s commitment to zero tolerance for corruption and misuse of position for personal gain,” he told reporters after reading the declaration, before starting his campaign at the Semenyih morning market here, today.

Meanwhile, the community activist said he agreed to participate in a debate between the candidates to be organised by Bersih 2.0.

“On the day I was announced as PSM’s candidate, I was contacted by representatives from Bersih 2.0 asking whether I was willing to participate in a debate organised by them and on the nomination day yesterday, I received a written invitation from them (Bersih 2.0), and my answer is that I am ready to take part in the debate,” he said.

According to Nik Aziz Afiq, the debate will be held on Feb 25 at the University of Nottingham Malaysia Semenyih Campus, located about 4km from Semenyih town and it is hoped that all the candidates who are contesting will participate in the debate.

Semenyih state seat by-election will see a four-cornered fight between Nik Aziz Afiq, Pakatan Harapan’s Muhammad Aiman Zainali, Barisan Nasional’s Zakaria Hanafi and Independent candidate Kuan Chee Heng.

The by-election is being held following the death of its incumbent, Bakhtiar Mohd Nor from Bersatu representing Pakatan Harapan, on Jan 11 after a heart attack. — Bernama

Why Parti Sosialis Malaysia should lift Semenyih: A reply to Rais Hussin — Arveent Kathirtchelvan

JANUARY 16 — I read with some interest the recent article written by Dr Rais Hussin on the upcoming Semenyih by-election. His cleverly titled article shifts the focus on the election to be somewhat of a straight fight between Pakatan Harapan (PH) and the PAS-Barisan Nasional (BN) contingent, calling it a D-Day. He goes on to defend Pakatan Harapan as a much better political coalition than PAS-BN, pointing out the latter’s association with kleptocracy, Israel and Goldman Sachs. It intrigued me to read about how Dr Rais views the central ideology of his opponents, Islam, as something more universal and finds it to don a key role in the statecraft of Malaysia.

His analysis is sound, but his conclusion is flawed due to his affiliation with PH, since he calls on Semenyih voters to cast their ballots for PH in spite of their imperfections to reject the baiting of Malays by PAS-BN through racial and religious verbiage. I echo his call for Semenyih to be a decisive election, not only to reject racial and religious extremism, but also to reject the false dichotomy that is inherent in Malaysian politics. Semenyih should fall not to PH or PAS-BN but PSM.

How is PSM Different?

Why do I say this? Well, from the outset I must admit my affiliation with PSM being a factor, whether I consciously admit to it or not. But even before I was a supporter of the PSM, I had promoted the diversification of Malaysian politics from a two-horse race to a multi-party system. A third-force is absolutely necessary. We can see this in the lack of differences between PH and BN-PAS.

BN, when it was holding the federal government, acted in an extremely neoliberal manner. The GDP growth was over-emphasised and the real impact on common people was not taken into consideration. Do we see a difference in this mentality in PH? Well, when the human resources minister and prime minister oppose any rise in the minimum wage, listening seemingly only to the Malaysian Employers’ Federation, we do not see a change in attitude to be more pro-worker. When the health and finance ministers announced the MySalam health insurance scheme with minimal to no stakeholder engagement, we don’t see a difference in the championing of private healthcare at the expense of public healthcare. When the state government in Penang held by PH is building houses named affordable but are, in reality, out of the price range of most people in Malaysia.

All of this shows PH is cut from the same cloth as BN. Are we really voting for an alternative if we vote the former to reject the latter? Yet it is PSM which is bringing forward new ideas that balance the need to secure statecraft and take care of the welfare of the rakyat. One can read these in our policy ideas for an alternative approach to healthcare, where we slow down the growth of private healthcare to build public healthcare that treats 70 per cent of the rakyat. Or one may read our view on how to make sure Multi-National Companies that do business in the Asean region do not exploit our cheap labour, by standing together and demanding for a better share of wealth for our people collectively. Or one can refer to our multi-pronged approach to dealing with affordable housing by taking people’s first homes out of the market and emphasizing on council houses a-la the United Kingdom and many other countries around the world.

Even more important is the way candidates are chosen to run in a certain constituency. PSM makes it mandatory that any aspiring candidate is firstly chosen by the local branch, has served the people in that constituency for at least two years and promises to not use a racial narrative in campaigning. Can we say the same about both PH and BN? Dato Seri Anwar Ibrahim certainly didn’t seem to have anything to do with Port Dickson and Wan Saiful Wan Jan seemed out of place in the hinterlands of Pendang, Kedah.

PSM’s strength lies in the strengthening of the rakyat. The emphasis is on removing the vulnerability of the people and uplifting Malaysians such that the lower class are not exploited by the upper class. PSM does this by organising marginalised workers, residents living in squalor due to mismanagement of their living space and the general masses to provide a strong narrative of the rakyat to the powers that be. PSM is on the ground not for race and religion, but for the people of Malaysia to articulate their grouses and take what is rightfully theirs. PSM, unlike BN or PH, rejects neoliberalism and is committed to the welfare of the rakyat as the central philosophy driving its decision-making.

On top of that, PSM is committed to the development of local candidates articulating the needs of locals in a constituency. In the Cameron Highlands by-election, one may be impressed by PAS-BN’s choice of candidate being an Orang Asli, but it is PSM who put forth an Orang Asli candidate in the Jelai State Constituency under Cameron Highlands in the last election. PSM Semenyih’s activists and leaders are people that have been working in Semenyih for decades, taking up cases forgotten by the mainstream political forces and navigating through an unequal Malaysia to uplift the marginalised classes without once capitalising on divisive racial narratives.

PSM’s Work In Semenyih

Focusing on Semenyih now, can any candidate, hand-on-heart, say they have done a similar amount of work PSM has? One only has to go to the branch itself, an unassuming first floor of a shop lot, to see the over 2,000 casef iles PSM Semenyih has solved. They are neatly arranged in hard-cased folders on a burgeoning bookshelf. In it are a variety of cases, ranging from land disputes to unlawful expulsion from work and even personal cases involving familial disputes. Even now, one can find new cases stacked-up on the table of the branch coordinator, Arutchelvam (commonly known as Arul) and notice the steady stream of people at their wits end looking up PSM Semenyih’s address as they know that if they come to this branch, they have a good chance in winning their case.

And how many cases have they won? Workers in multiple plantations have been helped to attain low-cost houses that they were promised by the plantation owners before slyly being cheated out of them. Just ask their families in Ladang Sg Rinching, Ladang Denudin and Ladang Semenyih. In Kampung Broga, 159 residents were helped to get land grants stretching for 99 years by PSM Semenyih. Workers in dispute with their employers were assisted to organise and fight for their rights in the Industrial Relations Department or the Labour Court by PSM Semenyih.

So, varied is PSM Semenyih’s repertoire that they even managed to win some land that was being used as a cemetery which was threatened to be eradicated by profit-minded developers. Are we to deny these?

What would a PSM victory in Semenyih mean for politics in Malaysia? One, it would break the hegemony of the two-party system in Malaysia which has produced governments and oppositions that are no different from each other fundamentally.

Two, it will solidify the need for a new narrative in Malaysian politics other than neoliberal policies and shift the focus to more sustainable, people-driven politics. Three, it will signal the end of parachute candidates and raise the bar across the board for all future candidates to have actually worked for a significant amount of time in a constituency. Four, it will toss the spectre of race and religion from politics completely rather than simply give it a new face with PH more and more concerned with how voters perceive them through these categories. Fifth, it will ensure the inclusion of a member of the Legislative Assembly in Selangor who not only has the people’s welfare at heart but also access to a huge wealth of experience in handling the issues of the people. The latter also ensures this member would have access to the resources necessary in building robust systems that would ensure these very problems are eradicated at the source and not just superficially.

This is why the people of Semenyih should reject PH and BN in favour of the only party putting their welfare in the forefront of its struggle. It is Parti Sosialis Malaysia who should lift Semenyih into a new narrative for national politics. Long live the people of Malaysia, long live the struggle.

KAJANG, SELANGOR – 16 Februari 2019: Pilihanraya Kecil (PRK) kawasan DUN N24 Semenyih akan menyaksikan pertembungan 4 penjuru, dengan Parti Sosialis Malaysia (PSM) mengambil bahagian dalam pilihanraya kecil untuk kali pertama, walaupun ini merupakan kali ke-4 PSM meletakkan calon untuk bertanding di kawasan DUN Semenyih.

Proses penamaan untuk PRK Semenyih berlangsung di Dewan Seri Cempaka MPKJ pada hari ini. Suruhanjaya Pilihan Raya (SPR) telah menerima 4 pencalonan. 4 calon yang akan bertanding ialah:

  1. Muhammad Aiman bin Zainali (Pakatan Harapan – BERSATU)
  2. Zakaria bin Haji Hanafi (Barisan Nasional – UMNO)
  3. Kuan Chee Heng (Bebas)
  4. Nik Aziz Afiq bin Abdul (Parti Sosialis Malaysia)

Penyokong-penyokong PSM telah mengiringi calon PSM Nik Aziz Afiq ke pusat penamaan calon dengan perarakan yang penuh bersemangat. Turut hadir bersama pada hari ini termasuk Dr. Nasir Hashim (Pengerusi PSM), A. Sivarajan (Setiausaha Agung PSM), S. Arutchelvan (Ahli Jawatankuasa Pusat PSM yang pernah bertanding di Semenyih untuk 3 Pilihanraya Umum yang lepas), Soh Sook Hwa (Bendahari PSM) dan Dr. Kua Kia Soong (aktivis sosial). Keluarga Nik Aziz termasuk ibu dan bapanya juga hadir untuk memberi sokongan kepada anak kesayangan mereka. Laungan slogan “Hidup Rakyat!”, “Hidup Sosialisme!” dan nyanyian lagu “Pembebasan” telah memeriahkan suasana di luar pusat penamaan calon.

Setelah selesai proses pencalonan, Nik Aziz Afiq berucap di hadapan penyokong-penyokong, “Ini bukannya calon Nik Aziz, tapi calon sosialis, calon rakyat!”

Nik Aziz berkata, “Saya nasihatkan rakan-rakan sekalian supaya berkempen dengan penuh rendah diri, dengan penuh rasa sederhana, dan tidak memburuk-burukkan parti lawan. Kita akan tunjukkan apa yang kita buat (untuk membantu rakyat) dan apa yang kita mampu lakukan.”

“Menang kami berkhidmat, kalah pun kami berkhidmat. Memang ini cara politik PSM, tetap berkhidmat untuk rakyat!” begitu katanya Nik Aziz.

Dengan ini, bermulah kempen PSM untuk PRK Semenyih. Walaupun PSM menghadapi cabaran yang amat hebat dalam PRK Semenyih, khususnya berdepan dengan dua gergasi politik (Pakatan Harapan dan Barisan Nasional), namun dengan semangat melawan arus dan meraikan demokrasi, PSM akan berusaha sebaik mungkin untuk menawarkan alternatif politik baru yang bernafas segar kepada pengundi Semenyih. PSM sedia menawarkan semak-dan-imbang yang sebenar dalam Dewan Undangan Negeri Selangor dengan halatuju dasar yang berdasarkan kesejahteraan rakyat terbanyak.

Latar belakang PRK Semenyih

Kerusi DUN Semenyih di Selangor dikosongkan selepas penyandangnya Bakhtiar Mohd Nor meninggal dunia pada 11 Januari 2019. Pakatan Harapan menang kerusi DUN Semenyih dalam PRU-14 pada 9 Mei 2018 dengan memperolehi 23,428 undi (50.76%) dalam pertandingan 4 penjuru yang melibatkan calon daripada Pakatan Harapan, Barisan Nasional, Parti Islam Se-Malaysia (PAS) dan Parti Sosialis Malaysia (PSM).

Menurut SPR, daftar pemilih yang akan digunakan untuk PRK ini mengandungi 54,503 orang pemilih berdaftar. SPR mensasarkan 70% pengundi akan keluar mengundi.

PSM pernah meletakkan calon untuk bertanding di kawasan DUN Semenyih untuk 3 PRU sebelum ini, iaitu pada tahun 2008, 2013 dan 2018. Calon PSM untuk kerusi DUN Semenyih dalam PRU-14, S. Arutchelvan, hanya mendapat undi sebanyak 1,293 undi (2.8% daripada jumlah undi). Oleh itu, PRK kali ini memang satu pertandingan yang amat mencabar untuk PSM.

PRK Semenyih kali ini merupakan kali yang ke-4 PSM bertanding di kawasan DUN N24 ini, dengan menyaksikan pertandingan 4 penjuru. PRK Semenyih merupakan pilihanraya kecil yang ke-4  untuk negeri Selangor sejak PRU-14. Calon PSM merupakan calon nombor 4 dalam kertas undi. Nampak adanya jodoh antara PSM Semenyih dengan nombor 4.

Dalam satu “pendedahan” dalam laman Facebook Nik Aziz, calon Pakatan Harapan untuk PRK Semenyih kali ini, Aiman Zainali, ialah pencadang bagi Allahyarham Bakhtiar dalam PRU-14 di kawasan DUN Semenyih, sementara Nik Aziz sendiri ialah pencadang untuk calon PSM S. Arutchelvan dalam PRU-14. “Tak sangka kami bertemu sekali lagi di dewan sama tetapi kali ini sebagai calon,” kata Nik Aziz.

Parti Sosialis Malaysia has urged the Penang Islamic Affairs Council (MAIPP) to put a stop to the eviction of 19 families from the Tanah Wakaf Abdul Cauder in Butterworth.

R Karthiges, coordinator of Penang PSM’s housing network, said the families have already been informed that they will be “chased out” (usir keluar) tomorrow by MAIPP, who own the mixed development project.

“The families refuse to leave, as not all were offered free replacement homes, and five families were left out. The RM500 rental fees offered to the families (pending compensation) are not enough to rent a house around Butterworth,” he said in a statement.

Ramai antara rakan-rakan kita mengharapkan kebangkitan Parti Sosialis Maaysia (PSM) supaya menjadi kuasa ketiga dalam arena politik hari ini.

Selepas perubahan kerajaan di beberapa buah negeri pada tahun 2008 dan perubahan rejim di peringkat pusat pada tahun 2018, kita mengharapkan bahawa pembukaan ruang politik dapat membawa lebih banyak kemungkinan, termasuklah perubahan dasar dan pembaharuan sistem. Mungkin ada orang merasakan masih terlalu awal untuk menilai prestasi kerajaan baru, namun ada juga orang tidak dapat tunggu lagi. Walau bagaimanapun, Barisan Nasional telah menunjukkan segala kelemahannya setelah kehilangan kuasa pemerintahan, manakala pelbagai U-turn dan sikap tidak konsisten yang ditonjolkan oleh kerajaan baru turut menimbulkan kekhuatiran bahawa dasar yang dibawa oleh kedua-dua gabungan politik yang utama semakin mirip sesama sendiri.

Selain Pakatan Harapan dan Barisan Nasional, adakah pilihan lain untuk kita semua?

Dalam realiti politik, memang kekuatan dan sumber yang dimiliki oleh PSM pada masa kini masih lagi belum mencukupi untuk menjadi kuasa ketiga. Berdepan dengan Pilihanraya Kecil di kawasan DUN Semenyih dalam keadaan sebegini, meletakkan calon untuk bertanding bagaikan sesuatu yang melawan arus.

Namun, bukankah semua perubahan masyarakat itu bermula daripada usaha melawan arus yang tidak mengerti kekalahan? Setiap perjuangan adalah titik permulaan untuk melangkah ke masa depan. PSM sanggup bergerak selangkah demi selangkah, bertekad mencabar budaya politik yang kolot, menawarkan satu pilihan alternatif kepada para pengundi dan bersedia untuk disemak pengundi.

Jawatankuasa Pusat dan Cawangan PSM telah memutuskan untuk bertanding dalam Pilihanraya Kecil Semenyih yang amat mencabar ini. Kami berharap dengan penyertaan dalam proses politik negara kita ini, dapat menggantikan politik perkauman dengan politik berasaskan perspektif kelas, menjana perbahasan dasar-dasar negara yang berasaskan idea-idea politik membina, dan menghapuskan budaya politik elitik dengan demokrasi bersifat partisipasi.

Bukit Kledang digondol, pihak berkuasa Perak gagal laksana tanggungjawab

IPOH – 9 FEBRUARI 2019: Aktivis-aktivis daripada Parti Sosialis Malaysia (PSM) membuat aduan polis pada hari ini terhadap Kerajaan Negeri Perak kerana membiarkan pembersihan hampir 10 hektar tanah hutan simpan dan penanaman kelapa sawit di Bukit Kledang Saiong. Aduan polis tersebut dibuat di Ibupejabat Polis Daerah Ipoh. Rombongan PSM diketuai oleh R. Mohanarani, Ahli Jawatankuasa Pusat PSM.

Syarikat MB Inc yang merupakan pemilik untuk sebahagian tanah yang diteroka secara haram di Bukit Kledang, telah mengeluarkan satu kenyataan pada 8 Februari 2019 yang mengatakan bahawa pihak MB Inc tidak tahu tentang pembersihan kawasan hutan yang begitu luas ini dan rancangan pembangunan di situ. Ini telah menimbulkan kerisauan ramai.

“Kami membuat aduan polis ini kerana kami mahu polis menyiasat perkara-perkara ini dan mengambil tindakan tegas terhadap penceroboh tanah hutan yang seluas 10 hektar di Bukit Kledang. Tindakan juga perlu diambil terhadap semua pihak, termasuk pegawai kerajaan dan penguatkuasa, yang cuai dalam melaksanakan tanggungjawab mereka untuk melindungi hutan simpan ataupun bersubahat dalam pencerobohan ini,” begitu katanya R. Mohanarani semasa membuat aduan polis di IPD Ipoh hari ini.

Dalam aduan polis yang dibuat pada hari ini, PSM telah menyeru pada pihak polis supaya menyiasat perkara-perkara berikut:

1. Mengapakah badan-badan penguatkuasa berkaitan dengan tanah, penjagaan bukit dan hutan, serta pihak polis tidak menghentikan dengan serta-merta pencerobohan haram di Bukit Kledang?

Adalah mustahil untuk pihak berkuasa (Jabatan Perhutanan, Pejabat Tanah dan Galian, Pejabat Tanah dan Daerah, dan Ibupejabat Polis Daerah Ipoh) tidak sedar tentang pemusnahan kawasan hutan seluas 10 hektar yang berlaku di depan mata mereka. Lebih-lebih lagi penerokaan tanah tersebut melibatkan sebilangan besar jentera berat. Orang awam pun sudah mula sedar bahawa satu kawasan luas di lereng Bukit Kledang dibersihkan secara tiba-tiba pada hujung bulan Januari tahun ini.

Mengapakah semua jabatan kerajaan ini gagal melaksanakan tanggungjawab mereka dan mengambil tindakan tegas secara serta-merta untuk menghentikan pembersihan tanah yang haram ini?

2. Siapakah individu/pihak yang mencerobohi tanah hutan seluar 10 hektar ini, dan siapakah yang melindunginya?

Pencerobohan secara terang-terang terhadap satu kawasan hutan yang sangat luas, yang dimiliki kerajaan dan syarikat miliknya MB Inc, serta penanaman kelapa sawit tanpa sebarang permit atau lesen, menunjukkan bahawa tindakan ini dilakukan oleh pihak yang merasakan dirinya kebal dan tidak risau tentang tindakan akan diambil terhadapnya.

Polis harus menyiasat siapakah pihak ini, siapakah yang melindunginya dan bagaimana dia berjaya mencerobohi Bukit Kledang secara haram tanpa diambil tindakan oleh pihak penguatkuasa.

3. Mengapakah Kerajaan Negeri Perak tidak berunding dengan rakyat tentang pembangunan di Bukit Kledang?

Kenyataan MB Inc pada 8 Februari 2019 amat merisaukan kerana pegawainya memaklumkan bahawa rancangan MB Inc adalah untuk membangunkan projek “hartanah bercampur” bagi penempatan penduduk di situ. PSM telah terdengar ura-ura yang menyatakan bahawa ada rancangan untuk “hutan perladangan”(plantation forest) dan jumlah keluasan hutan yang akan dibersihkan adalah 24 hektar lebih.

Adakah perlu untuk Bukit Kledang yang merupakan satu aset semulajadi indah dan tempat kegemaran untuk  pendaki bukit serta pelancong dimusnahkan untuk projek perumahan? Rumah untuk siapa? Mengapa tidak menggunakan tanah rata di tempat lain di sekitar Ipoh? Mengapa tidak menggunakan Akta Pengambilan Tanah untuk ambil tanah ladang yang jauh lebih luas untuk melaksanakan projek perumahan?

Pembangunan di lereng bukit boleh menyebabkan kejadian tanah runtuh, terutamanya semasa hujan lebat yang kini menjadi satu kebiasaan. Adakah Menteri Besar Perak, yang juga selaku Pengerusi Jawatakuasa Tanah Negeri Perak dapat menjamin pembangunan di lereng bukit ini tidak akan mengancam nyawa dan keselamatan penduduk-penduduk berhampiran, dan juga pengguna-pengguna Lebuhraya Ipoh-Lumut? Adakah Menteri Besar Perak dapat menjamin bahawa pembersihan hutan untuk projek perumahan tidak akan menyebabkan hakisan tanah, pemendapan sungai dan banjir besar di kawasan perumahan berhampiran dan juga di kawasan hilir sungai? Apakah keputusan kajian impak alam sekitar (EIA) terhadap skim pembangunan ini?

KDN sekat hak pengawal keselamatan untuk berhimpun – sesuatu yang tidak masuk akal

KDN sekat hak pengawal keselamatan untuk berhimpun – sesuatu yang tidak masuk akal

 

Kementerian Dalam Negeri (KDN) cuba menyekat hak pekerja untuk berhimpun dan menyuarakan tuntutan mereka dengan cara mengeluarkan surat peringatan kepada pihak majikan supaya tidak membenarkan pekerja berhimpun.

KDN telah mengeluarkan sepucuk surat kepada Persatuan Perkhidmatan Kawalan Keselamatan Malaysia (PPKKM) (dalam surat ditulis sebagai Persatuan Industri Kawalan Keselamatan) pada 30 Januari 2019 dengan tajuk “Peringatan kepada syarikat kawalan keselamatan untuk tidak membenarkan pengawal keselamatan daripada mengikuti perhimpunan jaminan kerja tetap untuk pekerja kontrak kerajaan sekolah pada 31 Januari 2019, jam 10.30 pagi di Kementerian Malaysia, Putrajaya”.

Dalam surat tersebut, KDN “menasihati semua syarikat kawalan keselamatan supaya tidak membenarkan pengawal keselamatan masing-masing daripada terlibat dengan perhimpunan tersebut. Semua syarikat pembekal perkhidmatan kepada kerajaan mempunyai obligasi untuk memastikan pengawal keselamatan yang dilantik berkelakuan baik, bertatatertib, mematuhi peraturan-peraturan dan tidak melakukan perbuatan-perbuatan buruk, salah laku atau menyalahi undang-undang semasa tempoh perjanjian perkhidmatan”. KDN juga mengatakan bahawa Kementerian Pendidikan memaklumkan kepada KDN tentang perhimpunan tersebut.

Walaupun KDN menggunakan perkataan “menasihati” dalam surat, namun amat jelasnya tujuan surat ini bersifat intimidasi dan memberi amaran kepada syarikat kawalan keselamatan supaya menghalang pekerja-pekerja mereka terlibat dalam aksi perhimpunan berkenaan. KDN merupakan badan kerajaan yang mengeluarkan lesen kepada kesemua syarikat kawalan keselamatan yang mengganggotai PPKKM.

Surat “peringatan” sebegini juga menakut-takutkan pekerja yang hanya ingin mengemukakan tuntutan mereka kepada pihak kerajaan.

Kenapa pengawal keselamatan yang menghadapi masalah ketidakjaminan kerja tidak boleh berhimpun untuk menyuarakan tuntutan mereka supaya hak asasi mereka dilindungi? Adakah berhimpun secara aman untuk menyuarakan tuntutan kepada pihak berkuasa itu sesuatu yang menyalahi undang-undang? Bukankah Perkara 10 dalam Perlembagaan Persekutuan telah jelas termaktub bahawa “semua warganegara berhak  untuk  berhimpun  secara aman  dan  tanpa  senjata”?

Adakah tindakan seseorang warganegara menggunakan hak demokratik untuk berhimpun secara aman itu sesuatu salah laku atau kelakuan yang tidak baik bagi KDN?

Aksi di hadapan Kementerian Pendidikan yang diadakan oleh Jaringan Pekerja Kontrak Kerajaan pada 31 Januari 2019, bertujuan untuk membawa tuntutan pekerja kontrak kerajaan sekolah berkenaan dengan jaminan kerja tetap kepada perhatian pihak Kementerian Pendidikan yang menyumberkan luar perkhidmatan sokongan (seperti kawalan keselamatan dan pembersihan) kepada kontraktor swasta.

Pekerja-pekerja pembersihan dan kawalan keselamatan di sekolah-sekolah kerajaan menghadapi masalah besar baru-baru ini apabila kontrak lama digantikan dengan kontrak baru. Ramai pekerja pembersihan di sekolah kerajaan diberhentikan kerja apabila kontraktor baru mengambailalih. Nampaknya Kementerian Pendidikan telah membuat keputusan untuk mengurangkan jumlah pekerja dan mengakbatkan sebilangan besar pekerja tidak diupah semula oleh kontraktor baru. Pekerja-pekerja ini hilang kerja secara tiba-tiba, tanpa sebarang notis dan tidak diberi pampasan, kerana mereka merupakan pekerja kontrak yang tidak mempunyai jaminan kerja. Oleh yang demikian, pekerja-pekerja yang tidak dijamin kerja mereka terpaksa membawa isu ini kepada perhatian Kementerian Pendidikan.

Penyerahan memorandum kepada Kementerian Pendidikan memang berlangsung secara aman dan lancar, dengan pegawai Kementerian Pendidikan bersedia untuk membincangkan isu ini. Jadi, adalah tidak masuk akal untuk KDN mengeluarkan surat “peringatan” yang menakut-takutkan pekerja supaya tidak hadir dalam aksi ini.

Tindakan KDN mengeluarkan surat “peringatan” kepada PPKKM yang bertujuan untuk mengintimidasi dan menghalang pengawal-pengawal keselamatan daripada membawa isu berkaitan dengan jaminan kerja mereka kepada perhatian Kementerian Pendidikan, adalah sesuatu yang tidak patut berlaku. Tindakan sebegini bukan sahaja mencabuli hak asasi rakyat untuk menyampaikan keluhan dan tuntutan mereka kepada pihak berkuasa, tetapi juga menunjukkan kegagalan pihak KDN dalam memahami kemelut yang dihadapi oleh pengawal-pengawal keselamatan di Malaysia, khususnya mereka yang berkhidmat di premis-premis kerajaan seperti sekolah.
